A permanent residence permit may be obtained by those who meet the conditions listed in Art. 195 of the Act on Foreigners. They will include, among others: children staying under the parental authority of a Polish citizen, a foreigner with a permanent residence permit or a long-term resident of the EU, spouses of Polish citizens and foreigners of Polish origin, refugees, as well as persons of Polish origin who intend to settle permanently in Poland.
A temporary residence permit may be obtained by a foreigner who intends to stay in Poland for longer than 3 months. They are issued for a maximum of 3 years, upon application submitted to the department responsible for foreigners at the voivodeship office. It is not possible to extend the permit – if a foreigner wants to legally stay in Poland longer than the validity period of the permit, they must apply for a new one.
