Can a foreigner buy a real estate in Poland?

Yes, but they must meet several conditions. They will usually need to obtain a permission to purchase the property. A foreigner may receive it if the acquisition of real estate does not pose a threat to Poland’s defence, security or public order, and is not contrary to social policy and public health considerations. A foreigner must also demonstrate their bond with the Republic of Poland – e.g. by having a residence permit, running a business in Poland or marrying a Polish citizen.

When is it possible to purchase a real estate without a permit?

Obtaining a permit to purchase a real estate is not necessary, among others: when a foreigner wants to purchase real estate for residential purposes and has lived in the Republic of Poland for at least 5 years since obtaining a permanent residence permit or a long-term EU resident’s permit, as well as when they are a spouse of a Polish citizen and has lived in Poland for at least 2 years since obtaining a residence permit, and the purchased real estate is to become part of the joint property of the spouses.
